Terms of Service

Acceptance of Terms

These Terms of Service govern your use of Prox, including the iOS app and this website. By using Prox, you agree to these terms. If you do not agree, do not use the service.

Eligibility and Age Requirement

You must be at least 13 years old to use Prox. By using the service, you represent that you are 13 years of age or older. If you are under the age of digital consent in your country or region, you may use Prox only with the involvement and consent of a parent or guardian.

What Prox Provides

Prox is a Bluetooth proximity app locker for iPhone. It applies app restrictions automatically when your device is near a Bluetooth trigger device you have registered, and releases them when you move away. Prox uses Apple's Family Controls, Core Bluetooth, and Core Motion frameworks to do this on your device.

Not a Substitute for Professional Help

Prox is a focus and digital-wellbeing tool. It is not a medical, mental health, or professional service. Prox is a productivity aid and does not guarantee any particular outcome. If you are in crisis or experiencing an emergency, contact local emergency services or a qualified resource immediately.

How Prox Works With Your Device

Prox depends on iOS system features, Bluetooth signal, and device permissions to function. Bluetooth signal strength varies with your environment, hardware, and interference, so proximity detection may not be perfectly precise in every situation. You are responsible for granting the permissions Prox needs (Bluetooth, Motion & Fitness, and Screen Time) and for choosing which apps a profile blocks or hides. Prox can only enforce restrictions on the selections you make within Apple's Screen Time picker.

Acceptable Use

You agree not to:

  • Use Prox to restrict or monitor another person's device without their knowledge and consent.
  • Use Prox in an organizational or workplace mobile-device-management context in a way that violates Apple's Family Controls terms.
  • Attempt to reverse engineer, tamper with, overload, or bypass the service, except as allowed by law.
  • Use Prox for any unlawful purpose.

Subscriptions and In-App Purchases

Prox offers a free tier and optional paid plans. Paid plans may include auto-renewing subscriptions and one-time purchases offered through Apple's App Store. Prices, billing periods, free trials, and renewal terms are shown in the app before purchase. App Store billing, renewals, cancellations, refunds, and payment methods are handled by Apple. We use RevenueCat to verify and restore purchases and to manage entitlement status. Auto-renewing subscriptions renew unless canceled at least 24 hours before the end of the current billing period. Manage or cancel subscriptions in your Apple account settings. Deleting the app does not automatically cancel an active subscription.

Third-Party Services and Terms

Certain features depend on third-party services, including Apple (for App Store billing and platform services) and RevenueCat (for entitlement verification and restoration). Your use of those features may also be subject to those third parties' terms and privacy policies. Prox is not responsible for third-party systems, outages, or policy changes.

Free and Paid Tiers

The free tier allows a limited number of registered devices and profiles. Unlimited devices and profiles, scheduling, and other features may require an active trial or paid plan. We may adjust the features included in each tier over time; current details are shown in the app at the time of purchase.

Intellectual Property

Prox's app, website, branding, designs, and software are owned by Prox or its licensors. You may not copy, resell, or reverse engineer the service except as allowed by law.

Service Changes and Availability

We may update, change, suspend, or discontinue parts of Prox at any time. We do not guarantee uninterrupted availability or error-free operation.

Termination

You may stop using Prox at any time. We may suspend or terminate access to all or part of the service if we reasonably believe these terms are violated, if required for legal or security reasons, or if the service is discontinued. Sections that by their nature should survive termination (including Intellectual Property, Disclaimer of Warranties, Limitation of Liability, and Governing Law and Disputes) will survive.

Disclaimer of Warranties

Prox is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty that Prox will detect proximity accurately or block apps without interruption in every situation.

Limitation of Liability

To the fullest extent permitted by law, Prox will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or service interruptions arising from your use of the service.

Governing Law and Disputes

To the fullest extent permitted by law, these terms are governed by the laws of the jurisdiction where the Prox operator is established, without regard to conflict-of-law rules. If a dispute arises, you agree to contact us first at hello@ninooonin.com so we can try to resolve it informally. If not resolved, disputes will be brought in the competent courts of that jurisdiction, unless applicable law requires otherwise.

Changes to These Terms

We may update these terms as the service changes. Continued use of Prox after updated terms are posted means you accept the updated terms.
